The purpose of these general conditions of sale is to inform any buyer of the conditions and procedures under which the seller agrees to sell and deliver products ordered and to define the rights and obligations of both parties in respect of the sale of products by the seller to the buyer.
They automatically apply to any sale made by PLANTIN S.A.S., a company with a capital of 1,000,000.00 euros, whose registered office address is Route de Nyons - 84110 Puymeras, registered in Avignon under no. 706 920 212, whose intra-community VAT no. is FR81706920212, to any consumer or legal entity purchasing for their own needs, other than those relating to a business activity and relating to any product offered for sale via the Plantin sales web site www.truffe-plantin.com, agreeing to complete the required fields presented during registration and having a delivery address within one of the geographical areas served by Plantin.
TConfirmation by the customer of an order entered on the site has the force of full and complete acceptance of these general conditions of sale and conditions specific to the order. All orders require unreserved compliance with these general conditions of sale which take precedence over any other conditions, with the exception of any which have been expressly accepted by Plantin. Plantin reserves the right to modify its general conditions of sale at any moment. In such a case, the conditions that will apply will be those in force on the date the purchaser places his/her order
Every product offered on the site is accompanied by a precise description of its essential characteristics and price.
Prior to placing an order, the purchaser can read about the essential characteristics of the product(s) that he/she wishes to purchase on the Plantin sales site.
Photographs illustrating products are non-binding and merely indicate how the product is presented in a general way. They are in no way binding on the seller.
IV. Validity of offer
The offer to sell remains valid while stocks last.
If a product becomes unavailable after an order has been placed, the purchaser will be informed by email or telephone within 24 hours (one working day) of the order being placed.
He/she will then be asked to choose:
- to delay delivery until new stocks become available, where this is possible,
- to exchange the missing product for another one of equivalent quality and price,
- to cancel the order and receive a refund for the price paid.
V. Formation of contract - Orders
Access to the site
Plantin's web site can be accessed at the following address: www.truffe-plantin.com. The use of computer technology and telecommunications to access the Plantin web site is the buyer's own responsibility. The buyer is responsible for the cost of telecommunications for accessing the Internet and use of the site.
When placing an initial order, the purchaser must create a personal account on the Plantin web site.
To do this, he/she must enter an email address (used as the user's identifier) and a password and enter the following information: Surname and first name (street or road number) and building (number and/or letter) - town - post code - country and telephone number. These data are used for all subsequent orders for the purpose of providing the greatest possible level of customisation in monitoring.
The password chosen by the customer, linked to the email address entered (used as the user's identifier) is used to verify the identity of the person placing any order and to bind them to these terms and conditions. They have the force of an electronic signature under the terms of the law dated 13 March 2000. The customer alone is responsible for his/her identifier and password and will bear any consequences which might result from their use by third parties, to whom the details are known.
To place an order, the purchaser selects the products which he/she wishes to purchase, having noted their essential characteristics in the product description, and clicks on "Add to basket".
After selecting products and entering quantities, the purchaser may enter any reduction code available, before confirming the basket contents by clicking on "Place order".
He/she then selects the delivery address and delivery method, before making payment under the applicable conditions and confirms the order and makes payment.
All the data supplied by the purchaser is binding on him/her. In the event of an error by the customer in entering his/her personal or delivery details, in particular, the surname, first name, address, telephone number, email address, door entry code, resulting in the loss of the products, the customer remains liable for payment for the lost products and no refund will be issued. The confirmation recorded is used as proof and has the force of a signature and acceptance of the operations carried out.
The purchaser's order is confirmed by Plantin by email.
V. Payment - Prices
The prices for each product offered for sale on the Plantin web site are shown in euros TTC (inclusive of all taxes) and are the prices in force at the moment the order is confirmed by the purchaser, with delivery costs to be added.
Payment for orders is due immediately, in euros. The purchaser must make payment at the time the order is placed.
Payment is made on line by bank card (Carte Bleue, Visa or Eurocard Mastercard) via the Paybox 3D Secure system. An order cannot be shipped until full payment has been made for the goods and the delivery charge.
Delivery of the order may be suspended or even cancelled in the event of non-payment of the sum due by the purchaser or in the event of a payment incident.
At the moment of placing the order, the purchaser is invited to state the delivery address for his/her order. In the event that the invoicing and delivery addresses are different, the purchaser must make this clear.
The sale on line of products offered on the Plantin site is restricted to delivery destinations in Metropolitan France, Corsica, Germany, Austria, Belgium, Denmark, Spain, Finland, Greece, Ireland, Italy, Luxembourg, Netherlands, Portugal, the United Kingdom and Sweden.
Plantin undertakes to process every order as quickly as possible (48 hr).
Orders are processed Monday to Friday, subject to the availability of products.
Any order confirmed on Friday, Saturday or Sunday will be shipped on the following Monday, subject to stock being available.
Shipping costs are calculated automatically when the order is placed and are shown on the page showing the order total prior to final confirmation.
The carrier is chosen by the purchaser at the point the order is finalised.
Special case of orders containing fresh products: the preparation of an order for fresh products requires special packaging allowing the product to be maintained at the required temperature until delivery. Any order containing fresh truffles will be delivered by express transport.
If the purchaser or recipient is absent, the carrier will leave advice that delivery was attempted, inviting the customer to make contact to obtain delivery of his/her package. Products must be collected within 24 working hours due to their perishable nature.
The purchaser is responsible for information concerning the recipient's name and address (door code, floor, telephone number, etc.), so as to facilitate normal delivery and in order to avoid any delivery problem or delay, that might involve additional costs for re-delivery, for which the purchaser is responsible.
Orders cannot be delivered to a PO box number.
Delivery is to the purchaser's home address and requires a signature. The purchaser should check the condition and number of packages before signing for the delivery.
If there are discrepancies, damage or any other anomaly, the customer should write any reservations on the delivery note upon receipt of the package(s). Failure to comply with this clause will mean that there is no possibility of a claim against the carrier and no refund will be issued.
If products are missing from within the package, the customer must inform us within 24 hours of delivery. Beyond that time, no claim will be accepted.
No delayed delivery will give the purchaser any right to damages, retention or cancellation of the order.
Plantin cannot be held liable for any deterioration of the products as a result of late receipt of a package due to the absence of the customer or the person authorised to receive the delivery.
VIII. Right to change your mind
For all products, with the exception of fresh products, and in accordance with article L. 121-20 of the Consumption Code, the purchaser has seven clear days from the date of receipt in which to return products ordered, at his/her own expense, for a refund.
All orders will be honoured within the limits of stock availability. In the event that a product is not available, after an order has been placed for it, Plantin undertakes to advise the purchaser by email as quickly as possible. The purchaser can then ask for the order to be cancelled or request an alternative product.
Products returned must be in perfect condition, suitable for resale and in their original condition (packaging, accessories, instructions, etc.) and properly sealed.
The seller will not be held liable or at fault for any delay or subsequent failure to execute, due either to an act by the consumer or due to the unforeseen or unavoidable act of a third party to the contract or for a case of force majeure, as usually defined by French jurisprudence. Force majeure events, releasing the seller from its obligation to deliver, are considered to be war, riots, fire, strikes, accidents and breakdown in supply.
The seller cannot be held liable for damage resulting from use of the Internet, such as loss of data, intrusion, viruses, interruption of service or any other problem.
IX. Computers and Freedom
Information collected by Plantin during any transaction with the buyer is necessary for the administration of the order by Plantin. In accordance with the "Informatique et Libertés" law, no. 78-17 of 6 January 1978, the purchaser has a right of access, rectification, objection and deletion in respect of data held by Plantin and concerning him/her by contacting firstname.lastname@example.org
Plantin may inform the purchaser of current offers. If the buyer does not wish to receive such offers, he/she may inform Plantin by letter or by email in the "contact" section.
As required by law 78/17 dated 6 January 1978 on computers, files and rights, the www.truffe-plantin.com site have been declared to CNIL.
X. Rules concerning disputes
These on-line conditions of sale are subject to French law.
In the event of a dispute, competence will be attributed to the competent courts under common law and, in the event of a dispute with professionals and/or traders, to the courts in Carpentras, notwithstanding there being multiple defenders or a third party claim.
